Green and Spiegel, an immigration law firm, successfully earned approval of H-1B status in federal court on behalf of a restaurant group (India House, Inc. v. McAleenan, et. al).
After a 2018 denial by USCIS and a 2019 denial on appeal by the Administrative Appeals Office, the parties sued USCIS and sought relief in federal court pursuant to the Administrative Procedures Act.
Jonathan Grode, U.S. Practice Director (Managing Partner) moderated the panel, which featured Green and Spiegel Senior Associate Attorneys Stephen Antwine, Matthew Galati, and Andrew Rodgers.
During this discussion, he talked about using a “specialty occupation” for the purposes of H-1B classification and how to submit previous USCIS denials for federal court review.
